AMENDMENT TO THE JOINP POWERS Ar• a p <br />BETWEEN THE CITY OF LITTLE CANADA AND THE CITY OF MAPLEWOOD <br />TO ALLOW THE CONNECTION OF CERTAIN REAL PROPERTY WITHIN THE <br />CITY OF MAPLEWOOD TO THE LITTLE CANADA MUNICIPAL SANITARY <br />SEWER AND WATER SYSTEMS <br />W I T N E S S E T H <br />WHEREAS, the City of Little Canada and Maplewood entered into a Joint Powers <br />Agreement on the 25th day of January, 1984. The Agreement was executed to be <br />effective November 1, 1983, and <br />i <br />WHEREAS, this Amendment is to define the maintenance agreement and use of <br />the utility system serving the City of Maplewood from the City of Little Canada. <br />NOW, THEREFORE, the parties agree to this Amendment as follows: <br />1. The City of Maplewood will perform all maintenance and repairs of the <br />water mains outside of Little Canada boundaries. <br />2. Use of the hydrants when deemed necessary for fire protection or flushing <br />of the system -- The City of Maplewood will notify the City of Little Canada <br />immediately so that the City of Little Canada will be able to estimate the amount <br />of water used and invoice the City of Maplewood accordingly. <br />3. Cost of water is a rate set by Council resolution with no service charge. <br />4. If a leak is detected in the system in the City of Maplewood, the City <br />of Little Canada reserves the right to shut down the water main to isolate the <br />leak until said leak is repaired at which time Little Canada will immediately <br />reinstate water service to the affected areas. <br />5. If a leak is detected, the City of Maplewood will be notified immediately <br />to perform repairs on the water main and will then be invoiced on an estimated <br />basis for water loss due to the break in the main. <br />IN WITNESS WHEREOF, the parties have executed this Amendment to be effective <br />, 19 <br />-1- <br />Page 75 <br />
