HAMMOND COMPLY WITH <br />ALL REQUIREMENTS OF THE ENGINEER IN THE MANNER AND TYPE <br />OF FILL THAT IS PUT IN THE PROPERTY AND THAT THE PERMIT <br />MAY BE SUBJECT TO REVOCATION AT ANY TIME IF HE FAILS TO <br />COMPLY WITH THE ENGINEER'S SUGGESTIONS REGARDING THE FILL; <br />AND 4. THAT DRAINAGE AND CLEANING EASEMENTS FOR THE PONDING <br />AREA AND CHANNEL WOULD NOT BE USED FOR ANY PUBLIC PURPOSES <br />The foregoing resolution was duly seconded by Mr. Nadeau. <br />Ayes (4) Fahey, Nadeau, Hanson, Scalze. <br />Nayes (0). <br />Resolution declared adopted. • <br />This resolution appears in Resolution Book No. 6, Pages 133 and 134. <br />Councilman Fahey stated that the easement he is referring to in the <br />resolution for the pond is referenced in Carley's survey dated August, <br />1979. <br />Fahey also stated that once the Attorney has the easements for the area <br />he and the Engineer should prepare the cleaning and dredging plan for <br />the area. <br />Mrs. Nardini requested that when the fill plan is prepared, she and <br />Mr. Soldow would like to be informed in case they would wish to have <br />an engineer look at the plan. <br />Amending Mrs. Scalze introduced the following resolution and moved its adoption: <br />The <br />Agenda RESOLUTION NO. 80 -6 -209 - AMENDING THE AGENDA TO HEAR <br />ITEMS FROM THE FLOOR <br />The foregoing resolution was duly seconded by Mr. Nadeau. <br />Ayes (4) Scalze, Nadeau, Hanson, Fahey. <br />Nayes (0). <br />Resolution declared adopted. <br />The resolution appears in Resolution Book No. 6, Page 134. <br />Yorkton / Mr. Larry Lee of Yorkton Ltd.. appeared before the Council. Mr. Lee <br />Industrial informed the Council that when grading their industrial park <br />Park a mistake was made and some dirt was pushed onto the water works <br />property. This fill will now be removed. The Water Department has <br />asked Mr. Lee who will be responsible for the maintenance of the <br />ponding area on the industrial park property and the maintenance of <br />the pipe running into their property. <br />Mr. Lee requested of the Council their feelings for the disposition <br />of this ponding area. Should the City take over the ponding area or <br />should an association be formed by Mr. Lee to maintain the area. <br />Councilman Nadeau stated that it would be to the City's advantage to <br />own the ponding area.
