10/4/91 <br />RAMSEY - WASHINGTON METRO WATERSHED DISTRICT <br />MEMORANDUM OF AGREEMENT FOR <br />ABANDONED WELL SEALING COST -SHARE FUNDING <br />THIS AGREEMENT is made and entered into this 4th day of October , 1991, by and <br />between the Ramsey - Washington Metro Watershed District (hereinafter referred to as the <br />"District ") and City of I ittle Canada (herinafterreferred to as the <br />"Landowner "). <br />WHEREAS, the Minnesota Groundwater Protection Act (Minn. Stat. Chapter 1031) <br />requires the sealing of selected priority wells; and <br />WHEREAS, the Minnesota Groundwater Protection Act encourages landowner <br />participation by providing for a county cost -share sealing program for priority wells. <br />NOW, THEREFORE, the parties to this Agreement agree as follows: <br />1. The District will pay the Landowner an amount equal to 50 percent of the direct cost for <br />sealing the well located on Landowner's property, but not to exceed $1,000 per well. If <br />grant funds are also received from another agency, the District may limit its grant to <br />provide a total of 50% grant funds from all sources. Costs for locating a well or site <br />restoration are not eligible. Other costs associated with well sealing, such as water <br />sampling or geophysical logging, may be included in the direct cost for well sealing, but <br />only with the prior written approval of the District. <br />2. In order to be eligible for cost sharing: <br />a. The sealing must be done in accordance with the requirements of Minn. Stat. <br />Chapter 103I and the rules established by the Commissioner of Health relating to <br />the sealing of unused wells. <br />b. Payment will be made to the Landowner after the well is sealed by a contractor <br />licensed under Minn. Stat. Chapter 103I. <br />c. The contractor must file a sealed well report and a copy of the well record with the <br />Commissioner of Health and the District. <br />d. The Landowner must use a licensed well water contractor or a limited well <br />contractor who previously provided a bid submitted to the District with the <br />landowner's initial application. Any new bids must be approved in writing by the <br />District before the Landowner is entitled to proceed with the sealing and receive <br />cost -share payment. The District reserves the right to reject a bid. <br />e. The Landowner will contact the District's Administrator at least 24 hours before <br />the work is to be performed and the Landowner will allow authorized <br />representatives of the District, Minnesota Department of Health, or Minnesota <br />Board of Water and Soil Resources to inspect the work. <br />Page 6 <br />
