permitted by the Commissioner of Natural Resources if <br />he determines that, through other measures, lands are <br />adequately protected for the intended use. <br />D. All amendments to this Ordinance, including amendments <br />to the Official Zoning Map, must be submitted to and <br />approved by the Commissioner of Natural Resources prior <br />to adoption. Changes in the Official Zoning Map must <br />meet the Federal Emergency Management Agency's (FEMA) <br />Technical Conditions and Criteria and must receive <br />prior FEMA approval before adoption. the Commissioner <br />of Natural Resources must be given ten (10) days <br />written notice of all hearings to consider an amendment <br />to this Ordinance and said notice shall include a draft <br />of the ordinance amendment or technical study under <br />consideration. <br />916.080. PERMITTED USES. Uses having a low flood damage <br />potential and not obstructing flood flows shall be permitted <br />within the "FP ", Floodplain District to the extent that they are <br />not prohibited by any other ordinances and are allowed within all <br />districts which jointly apply, and provided they do not require <br />structure, fill, or storage of materials or equipment. In <br />addition, no use shall adversely affect the capacity of the <br />channels, or floodway of any tributary to the main stream, <br />drainage ditch or any other drainage facility or system. <br />Permitted uses are limited to the following: <br />A. Agricultural uses such as general farming, pasture, <br />grazing, outdoor plant nurseries, forestry, <br />horticulture, truck farming, sod farming, and wild crop <br />harvesting. <br />B. Residential: lawns, gardens, parking areas, docks, <br />piers and play area. <br />C. Industrial- Business: loading areas and parking areas. <br />D. Public and private recreational uses. <br />916.090. CONDITIONAL USES. The following uses require a <br />Conditional Use Permit based upon procedures set forth in and <br />regulated by Section 921 of this Ordinance. In addition, the <br />City Engineer shall determine whether the proposed conditional <br />use location is within a floodway or flood fringe area. Upon <br />such determination, the applicable conditions, provisions and <br />restrictions shall be imposed. The Commissioner of Natural <br />Resources shall be given at minimum ten (10) days notice of the <br />required public hearing and shall be advised in writing of <br />decisions made concerning any conditional use within ten (10) <br />days of the decision. <br />Page 33 <br />
