A. Floodway. <br />1. The following open space uses require accessory <br />structures (temporary or permanent), or fill or <br />storage of materials or equipment. These uses may <br />be permitted in the Floodway District only after <br />the issuance of a Conditional Use Permit: <br />a. Uses or structures accessory to open space or <br />conditional uses. <br />b. Extraction of sand, gravel, and other <br />materials. <br />c. Marinas and water control structures. <br />d. Railroads, streets, bridges, utility <br />transmission lines, and pipelines. <br />e. Storage yards for equipment, machinery or <br />material. <br />f. Placement of fill. <br />2. Standards for Floodway Conditional Uses. <br />a. No structure (temporary or permanent), fill <br />(including fill for roads and levees), <br />deposit, obstruction, storage of materials or <br />equipment, or other uses may be allowed as a <br />conditional use which, acting alone or in <br />combination with existing or anticipated <br />future uses, adversely affect the capacity of <br />the floodway, or increases flood heights. <br />Consideration of the effects of a proposed <br />use shall be based upon the reasonable <br />assumption that there will be an equal degree <br />of encroachment extending for a significant <br />reach on both sides of the stream. All <br />conditional use applications shall be <br />accompanied by a floodway impact statement <br />drafted by a registered engineer. The Zoning <br />Administrator shall be responsible for <br />submitting the proposal and application to <br />the Department of Natural Resources and any <br />other governmental unit having jurisdiction <br />over the area for review and comment. <br />b. Fill. <br />(1) <br />Any fill deposited in the floodway shall <br />be no more than the minimal amount <br />necessary to conduct a conditional use. <br />Generally, fill shall be limited to that <br />needed to grade or landscape for that <br />use and shall not in any way further <br />obstruct the flow of flood waters. <br />Page 34 <br />
