One of the <br />general performance standards of the zoning regulations is <br />the maximum investment for rehabilitating non - conforming <br />structures. The applicant is requesting a variance from <br />this standard, which will be discussed in greater detail <br />below. <br />4. The proposed use will not tend to or actually depreciate the <br />area in which it is proposed. <br />The proposed residence improvement should not depreciate <br />values in the area. <br />5. The proposed use can be accommodated with existing public <br />services and will not overburden the City's service <br />capacity. <br />This request has no effect on the City's service capability. <br />A review of these criteria has uncovered two deficiencies in the <br />proposal. The first is a lack of plans and information regarding <br />the proposed reconstructed building. The details of the "new" <br />structure re critical to evaluating its compliance with the <br />requirements of the conditional use procedures. The second is <br />the need for a variance from the fifty percent rate for <br />rehabilitating non - conforming buildings. In order to qualify for <br />the CUP, the variance must be justified and approved. <br />Variance. As mentioned previously, the applicant is requesting <br />a variance to allow repairs to the subject structure to exceed <br />fifty (50) percent of its existing fair market value ($9,000 per <br />Ramsey County). According to Section 903.010.C., nothing in the <br />Ordinance shall prevent the placing of a structure in safe <br />condition when the structure is declared unsafe by the Building <br />Official, providing the necessary repairs shall not constitute <br />more than fifty (50) percent of the fair market value of the <br />structure. The intent of the stated requirement contends that <br />structures which require repairs which would exceed fifty (50) <br />percent may be more appropriate for demolition than <br />reconstruction. According to the Zoning Ordinance, a variance <br />from its terms shall not be granted unless it can be demonstrated <br />that: <br />a. Special conditions and circumstances exist which are <br />peculiar to the land, structure, or building involved: <br />(1) Special conditions may include exceptional topographic . <br />or'water conditions or, in the case of an existing lot <br />or parcel of record, narrowness, shallowness, <br />insufficient area or shape of the property. <br />3 <br />Page 15 <br />
