According to Section 903.010.K. of the <br />Zoning Ordinance, non - conforming, non - income producing <br />residential units may be expanded to improve livability as a <br />conditional use, provided that the non - conformity of the <br />structure will not be increased. While the applicant's intention <br />to improve the existing non- conforming conditions is <br />appreciated, plans must be submitted which depict specific <br />structure alterations which are proposed. Such plans should <br />essentially "prove" that non - conformities will not be expanded. <br />Prior to the granting of the CUP, building plans should be <br />formally submitted to the City. <br />In reviewing the applicant's request, the Planning Commission <br />shall consider possible adverse effects to the proposed <br />conditional use. Its judgement shall be based upon (but not <br />limited to) the following factors: <br />1. The proposed action has been considered in relation to the <br />specific policies and provisions of and has been found to be <br />consistent with the official City Comprehensive Land Use <br />Plan. <br />The request is not changing the use of the land, only <br />adding an improvement to an existing condition. The request <br />is consistent with the Comprehensive Land Use Plan. <br />2. The proposed site is or will be compatible with present and <br />future land uses of the area. <br />This application again is not a change of use and therefore <br />is not inconsistent with future land uses in the area. <br />3. The proposed use conforms with all performance standards <br />contained herein. <br />While the applicant has indicated that she intends to bring <br />the structure up to minimum standards, plans must be <br />2 <br />Page 14 <br />
