MINUTES <br />PLANNING COMMISSION <br />AUGUST 8, 1991 <br />Bendel pointed out that when someone purchases a <br />property it is up to the buyer to do their homework, <br />and not incumbent on the City to educate purchasers. <br />McBride felt the situation was unique. MrBride <br />requested approval of the CUP and Variance, and assured <br />the Commission that the improvements he plans will <br />bring the property up to Code. <br />Drabik asked if it were better to have the existing <br />structure brought up to Code versus letting the <br />property sit vacant. <br />McBride pointed out that there are several nice looking <br />homes in the area, and felt the Favis property would <br />fit in once it is improved. <br />Bendel pointed out that condemnation proceedings are <br />not the charge of the Planning Commission. The <br />Planning Commission is a recommending body to the City <br />Council. <br />Herkenhoff pointed out that the other homes in this <br />area will remain, and felt that if the Favis house is <br />brought up to. Code, it would be a nice looking <br />structure. <br />Drabik asked if a precedent would be set if the <br />variance is approved. <br />The Planner suggested that if the Commission approves <br />the variance application, it declare its reasons for <br />doing so. If another variance application is made <br />which meets this same criteria, the City would be <br />comfortable with approval. <br />Bendel asked what types of improvements are planned for <br />the exterior of the structure. Bendel asked if the <br />City was comfortable with a structure of this <br />appearance long -term. <br />McBride replied that the structure will be scraped and <br />painted. Any existing siding that needs replacement <br />will be replaced. <br />Pedersen felt the situation was one that was inherited <br />and was pre -Code development. Pedersen felt that there <br />was no choice but to allow the CUP and Variance, <br />otherwise the property will end up as a vacant lot. <br />Pedersen did not believe there were any park plans for <br />the area, and pointed out that the area is sort of a <br />hodge -podge as it currently exists. <br />Page 4 <br />
