PC <br />Keen P Yapp. PE <br />Chanty A Ene4on <br />Leo M Pawtttky <br />Kaftan M (AtQn <br />Honorable Mayor and City Council; <br />We've submitted for your review our Report on Street Improvements for the Ryan <br />Industrial Park, We've reviewed this report with members of the City staff <br />and have come to the conclusion that a resolve to the street and utility needs <br />for the area encompasses a wider scope than just the Engineering concerns <br />presented within this preliminary report. <br />Prior to the City taking any further action regarding street improvements, <br />staff suggests that the history of the development of the Ryan Industrial Park <br />be reviewed. A legal review may be warranted given the fact that the City <br />hasn't yet accepted the road as public right - of-way. Is the City liable for <br />improvements due to the fact that building permits have been allowed? Is the <br />developer off the hook? <br />We propose that the engineering report be addressed in conjunction with a <br />prepared legal response to the concerns noted above.
