Lots 2 -12, Block 2, to the south do not meet minimum lot size as <br />drawn. The proposed lot size is only 9,975 square feet. Lot <br />dimensions must be redrawn to provide the 10,000 square foot <br />minimum lots. In addition, Lot 1 of Block 2 must be 11,000 <br />square feet in area as a corner lot. <br />Required building setbacks in an R -1 zone are as follows: <br />Front Yard: 30 feet <br />Side Yard: 10 feet interior lot <br />30 feet abutting a public right -of -way <br />Rear Yard: 30 feet <br />Streets, The subdivision is serviced by an extension of Jackson <br />Street. Jackson Street is currently only improved up to the <br />south boundary of the subject property. The extension of Jackson <br />Street will make a 90 degree turn and run straight down the <br />property ending in a cul -de -sac. The length of the cul -de -sac is <br />approximately 980 feet. • The Subdivision Ordinance only allows <br />cul -de -sacs up to 500 feet in length. As the plat is drawn, a <br />variance will be required from the cul -de -sac length requirement. <br />The variance request must satisfy the conditions governing <br />consideration of variance requests: <br />1. That there are special and highly unique circumstances or <br />conditions affecting said property which are not common to <br />other properties in the City and that the strict application <br />of the provisions of this Ordinance would deprive the <br />applicant of the reasonable and minimum use of his land. <br />2. That the granting of the variance will not be detrimental to <br />the public health, welfare or injurious to other property in <br />the territory in which property is situated. <br />3. That the variance is to correct inequities resulting from an <br />extreme hardship limited to topography, soils or other <br />physical factors of the land. <br />It has been noted that there exists a 60 foot wide R.O.W. along <br />the railroad leading into the Boss subdivision and connecting <br />with LaBore Avenue. If this is in fact a usable right -of -way, it <br />could be advantageous to connect the proposed cul -de -sac with the <br />Boss Addition. This would provide a connected street pattern and <br />a more efficient traffic flow pattern. If this connection is not <br />a workable solution, then a variance to the cul -de -sac length <br />would be an acceptable solution because there are no connections <br />to the north. <br />2 <br />Page 29 <br />
