with the sale of food. The application for such license may be <br />made at the same time and upon the same license as the "On -Sale" <br />licensee uses to apply for his regular "On- Sale" license. The <br />fee for a special Sunday liquor license shall be Two Hundred <br />Dollars ($200.00) per year. No such license shall be issued to <br />any "On -Sale" licensee unless said licensee is operating a <br />benefited restaurant serving meals regularly to the public and <br />having facilities for serving at least 30 people at one time. <br />No intoxicating liquor shall be served before 10:00 o'clock a.m. <br />or after 1:00 o'clock a.m. on Sunday. <br />Section 4. <br />Chapter 704 of the Municipal Code of the City of Little <br />Canada is hereby amended to read as follows:' <br />704. SPECIAL ON -SALE WINE LICENSES <br />704.010. WINE LICENSES. No person, except a wholesaler or <br />manufacturer to the extent authorized under the State License <br />Code shall directly or indirectly deal in, sell, or keep for <br />sale in the City any wine not exceeding 14% alcohol by volume <br />without an On -Sale Wine License. An On -Sale Wine License <br />authorizes the sale of wine not exceeding 14% alcohol by volume, <br />for consumption on the licensed premis s only, in conjunction <br />with the sale of food. An On -Sale Wine License may be is ued <br />only to a restaurant having facilities for seating not fewer <br />than 25 guests at one time. For purposes of this chapter, a <br />restaurant shall mean an establishment under the control of a <br />single proprietor or manager, having appropriate facilities for <br />serving meals, and where in consideration of payment therefore, <br />meals are regularly served at tables to the general public and <br />which employs an adequate staff to provide the usual and <br />suitable services to its guests. <br />704.020. LICENSE APPLICATION. Any person desiring a <br />special "On -Sale Wine License" shall make a verified application <br />in writing to the City Council and shall file the same with the <br />City Administrator. Such application form shall require that <br />the information set forth in Section 703.040 be provided. In <br />addition, the application must include the location of the <br />premises upon which the applicant proposes to sell such wine and <br />an exact description of the particular place within the building <br />where such sales will take place. <br />704.030. REQUIREMENTS FOR INTOXICATING LIQUOR LICENSE <br />GENERALLY APPLY. Except as modified or amended in this Section, <br />provisions of Section 703 regulating intoxicating liquor <br />licenses shall apply to special on -sale wine licenses. <br />-18- <br />Page 29 <br />
