,d -1991 1? :07 FROM SWIEENEY a BORER <br />TO LITTLE -CF1hI Da P.04/15 <br />DEVELOPMENT CONTRACT <br />AGREEMENT, dated , 19__, by and between the <br />City of Little Canada, a Minnesota municipal corporation <br />( "City ") and Rose Mary Costa, single, Peter Costa, Jr. and Ilene <br />Costa, husband and wife, ( "Developers "). <br />1. Request for Improvement. The Developers have requested <br />the City to allow the construction of public streets, utilities <br />and drainage areas within the proposed plat of Costa Estates, <br />within the City of Little Canada to serve the following <br />described property: <br />Lots 4 through 11 and 21 through 31, of Block 3, Gervais <br />Heights, Ramsey County, Minnesol4. <br />The improvements are necessary to provide access and <br />utilities to the lots in the proposed plat. <br />2. Conditions of Approval. The City hereby approves the <br />preliminary plat of Costa Estates pursuant to City Council <br />Resolution 91 -26 and further conditioned upon the Developers <br />entering into this Agreement and guaranteeing compliance with <br />the terms of this Agreement. <br />3. Compliance with Laws and Regulations. The Developers <br />represent to the City that to the best of their knowledge the <br />proposed improvements will comply with all city, county, <br />metropolitan, state and federal laws and regulations, including, <br />but not limited to, subdivision ordinances, zoning ordinances <br />and environmental regulations. <br />-1- <br />Page 51 <br />
