APR -05 -1991 17:08 FROM SWEENEY & BORER <br />TO LITTLE - CANADA P.05.15 <br />4. Development Exhibits. The Developers shall develop the <br />proposed plat in accordance with Exhibit A, attached hereto, and <br />on file in the offices of the City. <br />5. Required Improvements. It is acknowledged that the <br />Developers will be allowed to finalize the plat of this <br />development in stages. The first stage will consist of the <br />property abutting Desoto Street as indicated on Exhibit B. The <br />improvement to Costa Lane as set forth on the preliminary plat, <br />Exhibit A, may be undertaken before, after or simultaneously <br />with the improvements to Vanderbie Street. The City is under no <br />obligation to construct Costa Lane until the requirements of <br />this agreement and the City have bee.satisfied. The City does <br />kk <br />not warrant access to the development property, and DeVgloper <br />waives any and all claims against the City for damages resulting <br />from the Developer's property becoming landlocked in the event <br />the improvements to Costa Lane are not constructed. <br />6. Easements. The City will acquire other easements as <br />necessary from outside of the platted property for the <br />construction of the improvement. The location and cost of the <br />easement(s) shall be approved by the Developers. Such approval <br />shall not be unreasonably withheld. The Developers shall pay <br />all costs relating to the acquisition of the necessary <br />easements, including but not limited to attorneys' fees, <br />surveying, engineering, administration, and the cost of the <br />necessary property, which the Developers agree to pay within 30 <br />-2- <br />Page 52 <br />
