MAR-12-1991 15 :37 FROM SWEENEY • SORER <br />TO LITTLE- CRNADR F.03/13 <br />ORDINANCE NO. <br />AN ORDINANCE ADDING SECTION 817 TO THE <br />MUNICIPAL CODE OF THE CITY OF LITTLE CANADA, <br />RELATING TO THE LICENSING OF PAWN SHOPS <br />THE CITY COUNCIL OF LITTLE CANADA HEREBY ORDAINS AS FOLLOWS: <br />Section 1. <br />Sections 817.00 through 817.155 to the Municipal Code of <br />the City of Little Canada are hereby added to read as follows: <br />Section 817.00. Definitions. <br />Subd. 1. For purposes of this section the terms defined in <br />this subsection have the meanings given them. <br />Subd. 2. "Pawnbroker" means a person who loans money on <br />deposit or pledge of personal property, or other valuable <br />thing, or who deals in the purchasing of personal property <br />or other valuable thing on condition of selling the same <br />back again at a stipulated price, or who loans money <br />secured by chattel mortgage on personal property, taking <br />possession of the property or any part thereof so <br />mortgaged. <br />Subd. 3. "Secondhand goods dealer" means a person whose <br />regular business includes selling or receiving tangible <br />personal property (excluding motor vehicles) previously <br />used, rented, owned or leased. <br />Section 817.05. Exemptions. This section does not apply <br />to or include the following: <br />(a) The sale of secondhand goods where all of the <br />following conditions are present: <br />(1) the sale is held on property occupied as a <br />dwelling by the seller, or owned, rented or leased by <br />a charitable or political organization; <br />(2) the items offered for sale are owned by the <br />occupant; <br />(3) the sale does not exceed a period of 72 <br />consecutive hours; <br />Page 2 <br />
