MINUTES <br />PLANNING COMMISSION <br />JANUARY 10, 1991 <br />The Commission continued its discussion of the walkway <br />issue and decided to address it as a separate action <br />item from the preliminary plat itself. <br />Mr. Herkenhoff recommended approval of the preliminary <br />plat for Costa Estates as submitted with Costa Lane <br />horseshoeing onto Desoto subject to compliance with the <br />recommendations of the City Planner as contained in his <br />report dated January 7, 1991. <br />Motion seconded by Drabik. <br />Motion carried 6 - 0. <br />Keis pointed out that if the City requires the walkway <br />as part of the plat, purchasers of the lots will be <br />aware of the situation right from the start. Keis felt <br />the would be much easier than trying to put a path in <br />the area after it has been developed. <br />DeLonais felt that to keep people on the walkways, they <br />will have to be fenced. <br />Pedersen pointed out that without the walkway a small <br />child cannot get from Vanderbie to the park without <br />traveling a good distance by street. Pedersen pointed <br />out that the park is being constructed to serve the <br />community and the City should provide ready access to <br />the park. <br />Clarence Bruhn, a resident of the area, questioned the <br />liability to homeowners by having a walkway easement <br />through private property. <br />The City Planner explained that the liability would <br />rest with the City since the City is granting the right <br />to use the land as a walkway. <br />Mr. Bendel recommended that the City Council consider <br />requiring as part of the Costa Estates plat a single <br />walkway connecting Vanderbie Road to Costa Lane in <br />light of the benefits the walkway would provide to the <br />residents of the area. <br />Motion seconded by Pedersen. <br />Motion carried 4 - 2. DeLonais and Herkenhoff voting <br />against. <br />ADULT USE The City Planner presented to the Commission a proposed <br />ORDINANCE Adult Use Ordinance which would regulate these types of <br />Page 5 <br />
