CONTRACT FOR FIRE PROTECTION <br />1992 <br />CITY OF LITTLE CANADA <br />RAMSEY COUNTY, MINNESOTA <br />WHEREAS, the City of Little Canada is authorized by law to <br />provide fire protection for all of the property in said City, and <br />WHEREAS, the Little Canada Fire Department, Incorporated, is a <br />volunteer Fire Department, operating as a non - profit association <br />under the laws of the State of Minnesota and owns certain fire <br />equipment, trucks, etc. for fighting fires, <br />NOW, THEREFORE, the City of Little Canada and the Little Canada <br />Fire Department, Incorporated, hereinafter referred to as the City <br />and the Corporation, respectively, in consideration of the following <br />provisions and covenants, do hereby enter into this contract and <br />agreement on the day and date hereunto subscribed. <br />1. The City hereby engages the services of the Corporation to <br />answer fire calls and fight fires and generally to provide fire <br />protection to public and private property within the City of Little <br />Canada for a period of one (1) year commencing January 1, 1992 and <br />terminating December 31, 1992. <br />2. The Department agrees to answer all fire calls directed to <br />it by the public for assistance in fighting fires of any nature and <br />description within the legal limits of the City. <br />3. The Department also agrees to provide First Responder level <br />services relating to hazardous material incidents. The Department <br />will contract with another agency for containment and clean -up <br />services with cost of this contract to be passed on to the City as <br />part of the amount included in Item 4. <br />4. The City agrees to pay to the Corporation for its services <br />during the period above specified, and the Corporation agrees to <br />accept as full remuneration for its services during the said period, <br />the sum of $140,356.00 (One Hundred Forty Thousand, Three Hundred <br />Fifty -Six and no /100) payable in fourths with the first payment due <br />upon the execution of this Contract. Subsequent payments to be due <br />on April 1st, July 1st, and October 1st. <br />5. The Department shall fully and completely report all facts, <br />information, and data required by the City as specified on the form <br />to be provided by the City for that purpose, and such form shall be <br />subscribed by the Chief or other officer of the Corporation who was <br />in charge and present at the fire so reported. <br />6. The City assumes no responsibility hereby for any acts of <br />the Department, nor for any injuries or losses to members or to the <br />equipment or trucks of the Department; and the Department hereby <br />agrees to keep its men, equipment, and trucks properly covered by <br />insurance, so as to protect the Department, its members, the City, <br />and any third persons from any loss by reason of <br />-1- <br />Page 27 <br />
