MINUTES <br />PLANNING COMMISSION <br />JANUARY 9, 1992 <br />The Planner felt the Commission must consider whether <br />it would support additional requests that have the same <br />circumstances as this one. The Planner suggested that <br />if the Planning Commission approves this variance, it <br />might condition the approval that any future requests <br />must meet all building setbacks and that new building <br />sites must be in full conformance with the ordinance. <br />DeLonais pointed out that there could be a lot of <br />similar situations in the Vanderbie /Edgerton area. <br />Pedersen pointed out that a front yard setback variance <br />was approved for a property on Valento Lane, which he <br />believed had less of a reason for approval than the one <br />before the Commission tonight. <br />Herkenhoff recommended approval of the property <br />division and variance for lot width as requested by <br />Richard and Virginia Sykes for property located at 319 <br />Savage Lane with the reason for approval of the <br />variance the pre- existing conditions which exist, such <br />as shape of the lot, and based on the fact that the <br />proposal meets all other Code requirements, such as lot <br />size and setback minimums. <br />Motion seconded by Pedersen. <br />There was a 3 to 3 vote of the Commission. Garske, <br />Herkenhoff and Pedersen voting in favor, and DeLonais, <br />Drabik and Keis voting against. <br />Garske suggested that an alternative would be for Mr. <br />Sykes to contact his neighbor to the east to see if he <br />could purchase a small strip of land so that the <br />minimum lot width requirement could be met. <br />Mr. Sykes reported that he has not investigated this <br />option and reported that he will do so. <br />Herkenhoff recommended that the application for <br />property division and variance as requested by Richard <br />and Virginia Sykes be tabled until the next Planning <br />Commission meeting in view of the tied vote of the <br />Commission, and in order to give Mr. Sykes the <br />opportunity to investigate possible purchase of <br />property from his neighbor. <br />Motion seconded by Garske. <br />Motion carried 6 - 0. <br />Page 5 <br />
