Mayor & City Council <br />January 8, 1992 <br />Page 2 <br />The only other alternatives, if the Commission does not <br />reconvey portions of the interceptor no longer necessary to <br />the metro system to the City of Little Canada for a fair <br />value, are to either abandon the pipe or continue to <br />operate and maintain a pipe it does not use. Since the <br />pipe would form an important component of the City of <br />Little Canada's local waste water collection, there is no <br />reason to abandon the pipe and leave it unused. The second <br />alternative, in effect, operation of a pipe by the <br />Commission which it either needs or uses raises major legal <br />and insurance issues with the MWCC. Therefore, MWCC <br />believes reconveying to Little Canada the portions of the <br />interceptor not needed by the Commission is the best <br />alternative. <br />I have spoken with William Mollner of the MWCC, and he is <br />sending me copies of all maintenance work done on that <br />portion of that interceptor and a tape of when they <br />televised that section of the interceptor. At this point <br />in time I would recommend that the City of Little Canada <br />accept the reconveyance of the pipe contingent upon <br />satisfactory submission of records for maintenance and <br />inspections. <br />DBH:kpv <br />Enclosures <br />Page 29 <br />
