Bus circulation is another issue to consider. The mall should <br />be able to accommodate a safe bus loading zone near the bingo <br />entrance. The site plan appears to show accommodations for this <br />unloading area along the front of the mall, however, the <br />applicant would be required to submit site plans identifying an <br />actual loading area, address safe access to the mall, sufficient <br />stacking space for buses and a bus circulation pattern. <br />Any City approval for this CUP application is based on and only <br />for the appropriateness of the use within the mall and does not <br />give specific site approval for any bingo operations. At such <br />time a bingo operation wishes to locate in this mall, then <br />further review by the City is required to review the site and its <br />compliance with appropriate City licensing standards. <br />Any CUP approval is in no way a license approval for a bingo hall <br />to operate. The bingo operation will be subject to all state <br />laws pertaining to bingo and gambling operations and will require <br />all necessary licenses. <br />The applicant must also be aware that since this application is <br />based on speculation of retaining the bingo hall as a tenant, the <br />applicant must show efforts of progress or the CUP will lapse <br />from no use. The Ordinance states that whenever within one year <br />after granting a CUP, the use shall not have been completed or <br />utilized, such permit shall become null and void unless a <br />petition for extension is applied for. <br />RECOMMENDATION <br />Based on the information provided for review, our office would <br />recommend conditional use approval for a bingo use within the <br />Market Place Mall subject to the following conditions: <br />1. The applicant addresses exclusive entrance requirement for <br />the Planning Commission's satisfaction. <br />2.
