Bus circulation is another issue to consider. The mall should be able to accommodate a safe bus loading zone near the bingo entrance. The site plan appears to show accommodations for this unloading area along the front of the mall, however, the applicant would be required to submit site plans identifying an actual loading area, address safe access to the mall, sufficient stacking space for buses and a bus circulation pattern. Any City approval for this CUP application is based on and only for the appropriateness of the use within the mall and does not give specific site approval for any bingo operations. At such time a bingo operation wishes to locate in this mall, then further review by the City is required to review the site and its compliance with appropriate City licensing standards. Any CUP approval is in no way a license approval for a bingo hall to operate. The bingo operation will be subject to all state laws pertaining to bingo and gambling operations and will require all necessary licenses. The applicant must also be aware that since this application is based on speculation of retaining the bingo hall as a tenant, the applicant must show efforts of progress or the CUP will lapse from no use. The Ordinance states that whenever within one year after granting a CUP, the use shall not have been completed or utilized, such permit shall become null and void unless a petition for extension is applied for. RECOMMENDATION Based on the information provided for review, our office would recommend conditional use approval for a bingo use within the Market Place Mall subject to the following conditions: 1. The applicant addresses exclusive entrance requirement for the Planning Commission's satisfaction. 2.
