MAR-06-1992 16 ;04 FROM SWEENEY & BORER <br />TO LITTLE-CANADA P.05/06 <br />organizations' rights to continue such fund raising activities. <br />Lessees will allow the Little Canada Recreation Association to <br />use the concession stand and any subsequent improvements as well <br />as equipment for fund raising events. <br />9. Loss of Profits. The City is not liable for loss of <br />profits in the event the contract is cancelled, for any reason. <br />Lessees shall not be entitled to any future profits or damages <br />in the event that the City awards this contract to another firm <br />or retains the operation of the City activity at any time in the <br />future. <br />10. Compensation. Lessees shall pay to the City for the <br />privileges herein granted ten (10 %) percent of its gross sales, <br />payable on the day of each month. All gross sales will be <br />determined exclusive of State sales tax collected by Lessees. <br />11. Payment and Billing. The City shall read cash <br />registers used by Lessees at least once each month to determine <br />the City's commission. After reading the registers, the City <br />will bill Lessees the amount due to the City. Lessees shall pay <br />the amount due to the City within ten (10) days of the billing. <br />12. Maintenance of Facilities. Lessees agree to operate <br />the concession stand in a clean manner with quality products <br />sold at a fair market price. Lessees further agree to open and <br />secure the building during events and to police the area for <br />trash after each event. <br />-3- <br />Page 23 <br />
