MINUTES <br />CITY COUNCIL <br />APRIL 16, 1992 <br />WESTWINDS <br />TRAIL <br />EASEMENT <br />Morelan pointed out that the trees belong to Zietlow, <br />and he had the option of moving them or cutting them <br />down if he so desires. <br />Zietlow reported that he brought the subject of the <br />easement up so that he would know what he can or cannot <br />do with the property. Zietlow reported that if he has <br />to move the trees, he will. <br />Sanders suggested that in relocating the trees Zietlow <br />place them in the area of the easterly line of the 20 <br />foot easement. This will allow the trees room to grow <br />without interfering with any future walkway. <br />Fasciana recommended that a 10 foot walkway easement be <br />retained down the center of the existing 20 foot <br />drainage /utility easement adjacent to 105 East Old <br />County Road C. <br />Motion seconded by Bruce. <br />Motion carried 5 - 0. <br />Sanders presented the Commission with a drawing of the <br />proposed trail encircling the Westwinds ponding area. <br />Sanders pointed out that the drawing shows 6 foot trail <br />easements from the properties to the south of the pond, <br />except for Lots 3 and 4 where easement areas need to be <br />15 feet in width. The extra width in this area is <br />because of a tower location. In addition to the trail <br />easements, the diagram shows 20 foot landscaping <br />easements so that the City can do some tree planting <br />along the trail to provide some separation for the <br />property owners. <br />Fasciana asked if the property owners had agreed to the <br />trail easement. <br />Sanders reported that he and Ken Wehrle have met with <br />the property owners, and they have verbally agreed to <br />the easements. <br />Fasciana asked why the trail could not be located on <br />the north side of the tower. <br />Sanders replied that there is limited room on the north <br />side of the tower given the slope down to the pond. <br />Sherman pointed <br />the pond in the <br />Sanders replied <br />out that the trail looks very close to <br />area adjacent to Lots 1 and 2. <br />that this was correct, however, the <br />Page 4 <br />Page 20 <br />
