MINUTES <br />PLANNING COMMISSION <br />JULY 9, 1992 <br />plans are being redrawn to correct this error. The <br />Planner pointed out that the plans before the <br />Commission are what was approved a year ago. <br />At this point in the meeting, the neighbors looked over <br />the plans. <br />Herkenhoff stated that he felt the neighbors have <br />suffered because of what Larry Lee has done in his <br />development to the north, and that the City must take <br />some responsibility. Herkenhoff pointed out that the <br />neighbors have complained about this development, but <br />nothing was done. Herkenhoff felt that in fairness to <br />the neighbors, the matter should be postponed so that <br />the developer can meet with them. <br />Silbaugh pointed out that the plans before the <br />Commission do not address a buffer. <br />Bob Carrier felt if there was no buffer zone, the new <br />homes would not sell, the property would deteriorate, <br />and property values would be effected. Carrier <br />reported that the noise levels around St. Jude's <br />building are so high that there are warning signs <br />posted on the building advising that ear protection <br />should be worn. <br />Agnes Carrier reported that they have contacted St. <br />Jude's about this noise. St. Jude's did do something <br />to decrease the noise level, however, at times it is <br />just as loud as it was previously. <br />Herkenhoff asked if the City had a noise ordinance, and <br />if it does, it should be enforced. <br />The City Planner replied that there is a noise <br />ordinance in effect. <br />Keis stated that he understood the neighbors' concerns <br />for buffering, but pointed out that the development <br />itself will provide a buffer for the existing homes. <br />Herkenhoff suggested that the answer might be to <br />require a sound - barrier wall. <br />Keis did not believe the City could make that <br />requirement. <br />Drabik pointed out that the grading of the proposal <br />before the Commission this evening is different than <br />what was presented last year. Drabik asked if the <br />neighbors wanted the matter postponed because they are <br />angry with what has happened in the past, or because <br />they want to see more concrete information on paper. <br />Page 10 <br />
