MINUTES <br />PLANNING COMMISSION <br />JULY 9, 1992 <br />Bob Carrier stated that his concern was that people <br />buying the new homes will not stay long with the noise <br />and light pollution that exists. Eventually, then, the <br />property will deteriorate, and his property values will <br />be effected. Carrier pointed out that Larry Lee was <br />supposed to put a berm on the commercial property to <br />screen the residential area, however, the berm was <br />placed on the residential property. <br />Johnson felt that if a berm was to have been built on <br />the commercial property, it is the City's obligation to <br />see a berm placed there. Johnson felt the residential <br />area deserved a buffer zone, and this buffer was <br />deserved from the day the industrial park was <br />developed. <br />The City Planner pointed out that there is 330 feet <br />between the existing residential homes and the <br />industrial park. <br />Johnson pointed out that removal of the existing berm <br />will expose the entire area to the industrial park. <br />Johnson pointed out the concerns about lights and noise <br />coming from the industrial park. <br />The City Planner pointed out that the proposed homes <br />will be at least 20 feet higher than the top of the <br />existing berm. <br />Silbaugh indicated that the City has had a lot of <br />complaints about noise coming from the industrial park, <br />and these complaints should be addressed. <br />Herkenhoff felt that someone must be accountable and <br />responsible in this situation if the berm should have <br />been placed on the industrial property. Herkenhoff <br />asked where the City's inspector was. Herkenhoff <br />stated that these things have happened many times in <br />the City and this should not continue to happen. <br />Herkenhoff felt that past injustices should be <br />corrected. <br />Carrier felt that if the buffer were moved further <br />north it may help to direct noise up into the air <br />rather than directly at the residential properties. <br />However, Carrier pointed out that there was no room to <br />place the berm on the industrial property since there <br />are parking lots in the area where the berm should be. <br />The Planner felt there was no way to address the berm <br />issue unless a huge retaining wall was required. The <br />Planner felt if that requirement were made, the <br />developer would not proceed with the project. <br />Page 11 <br />
