MINUTES <br />PLANNING COMMISSION <br />JULY 9, 1992 <br />approval would be that the building is not used for <br />business purposes. <br />Keis stated that he would like to see the applicant <br />given some latitude on the exterior treatment of the <br />building. <br />Carson recommended approval of the application for <br />Conditional Use Permit for accessory storage building <br />more than 120 square feet in size as requested by <br />Steven and heather Sutton, 3001 Payne Avenue, subject <br />to compliance with the recommendations of the City <br />Planner as contained in his report dated July 2, 1992, <br />and subject to the building being sided to match the <br />house. <br />Motion seconded by Drabik. <br />Motion carried 6 - 0. <br />SYLVAN The City Planner explained that there is road right - <br />STREET of -way existing between the end of the Sylvan Street <br />cul -de -sac and Demont Avenue. There has been a problem <br />with the accumulation of debris in this area. City <br />staff is asking that vacation of the right -of -way be <br />considered, since it would then go back to the adjacent <br />properties and would be maintained. There are <br />utilities in this area, therefore, a utility easement <br />would need to be maintained. <br />Carson recommended the vacation of the Sylvan Street <br />right -of -way lying between the end of the cul -de -sac <br />and Demont Avenue. <br />Motion seconded by Herkenhoff. <br />Motion carried 6 - 0. <br />HOGGSBREATH Herkenhoff asked if a permit was taken out for the deck <br />constructed at Hoggsbreath. <br />The City Planner reported that a permit was issued for <br />this improvement. The Planner reported that the <br />additional seating that would be accommodated by the <br />deck does fall within the allowed seating capacity for <br />the Hoggsbreath. <br />CODE Various members of the Commission expressed concern <br />ENFORCEMENT about enforcement of building codes as part of building <br />inspections. It was felt that code violations are not <br />being identified during building inspections, and in <br />some instances inspections are not being done. <br />Page 15 <br />
