MINUTES <br />CITY COUNCIL <br />MARCH 11, 1992 <br />that the City never accepted the Ryan Industrial Park <br />streets because they were not constructed to City <br />standards. The City has performed some maintenance, <br />but that has been minimal. The City has done road <br />patching and plowed the streets to provide access to <br />emergency vehicles. The City has not done <br />crack - filling, except on Spruce Street in front of the <br />Frattalone property. That portion of street was <br />constructed to City standards. Harris reported that <br />the City recently used 15 ton of asphalt filling <br />potholes on the Ryan Industrial Park streets, and the <br />next day it was gone having sunk into the ground. <br />A property owner commented that the streets in Ryan <br />Industrial Park have been neglected and are now in such <br />poor condition that they are beyond repair. That <br />property owner pointed out that the owners in the Park <br />are paying property taxes, and when they bought their <br />properties they were of the understanding that the <br />streets were owned by the City. The owner felt that <br />the streets should have been maintained. <br />Blesener reported that the Ryan Industrial Park streets <br />were constructed without base under the bituminous. <br />When the streets were constructed, the City had the <br />understanding with Mr. Ryan that he was constructing <br />the streets in this manner at his own risk. The City <br />indicated at the time that they might assume <br />responsibility for the streets if they held up, <br />however, they did not. Therefore, the City could not <br />in good faith accept these roads. Blesener pointed out <br />that Mr. Ryan, Frank Frattalone, and a lot of other <br />property owners knew that the Ryan Industrial Park <br />roads were not City roads. <br />Collova asked Stanke if his property had ever been <br />assessed for road improvement. <br />Stanke replied that he has never received a road <br />assessment. <br />A property owner indicated that he has owned property <br />within the Park for the past 10 years. Up until a year <br />and a half ago, the roads were in pretty decent shape. <br />This property owner indicated that it is when the City <br />put in a sewer project that the roads began to <br />deteriorate. <br />Stanke asked who paid for the overlay and milling of <br />Ryan Drive. <br />Hanson replied that it was his understanding that Mr. <br />Ryan paid for an overlay which was done in the early <br />1980's. <br />Page 6 <br />Page 12 <br />
