EIGHTEENTH RIDER TO AGREEMENT <br />THIS AGREEMENT, Made this _ day of , 1992 by and <br />between the BOARD OF WATER COMMISSIONERS, CITY OF SAINT PAUL, hereinafter called <br />"Board" and the CITY OF LITTLE CANADA, County of Ramsey, State of Minnesota, <br />hereinafter called "City ", being the Eighteenth Rider to that certain Agreement <br />made by and between said Board and said City the 13th day of July, 1966 and by <br />this reference incorporated herein and made part hereof and with the same intent, <br />purpose and effect as if said Agreement were set forth herein verbatim. <br />WHEREAS, The Board is owner of a 100 foot wide right -of -way, within and upon <br />which there exists two 90 -inch diameter water supply conduits and is owner of an <br />adjacent and parallel right -of -way easement which varies in width from 60 to 85 <br />feet, which ownership is described as: <br />A 100 foot wide fee title right -of -way and an adjacent and parallel <br />60 foot, 70 foot and 85 foot wide strip of easement right -of -way in <br />Section 31, Township 30 North, Range 22 West and Section 6, Township <br />29 North, Range 22 West, Ramsey County. <br />WHEREAS, The City desires the public use of said Board right -of -way as a <br />corridor for construction and operation of a public trail for recreational <br />purposes, and <br />WHEREAS, The Board is willing to grant said permission to the City <br />consistent with the requirements and safety of the works of the Board; now <br />therefore, in consideration of the mutual promises and agreements of the parties <br />hereto, that said Board grants to the City permission for "limited use" upon the <br />above described right -of -way for the construction and operation of a public trail <br />for recreational purposes. The parties hereby agree as follows: <br />1. That the City agrees to govern and control the public use of said <br />right -of -way for recreational purposes through applicable park <br />and City ordinances, and answer all complaints that arise as a <br />result of such operation. <br />Page 4 <br />
