2. That the City agrees to prohibit access to the trail by all <br />motorized vehicles, except maintenance and emergency vehicles. <br />3. That the City design the access points to prohibit unauthorized <br />vehicles from entering the trail. <br />4. That the City agrees to adequately sign the right -of -way for safe <br />operation of the trail. <br />5. That the City shall be responsible for obtaining any crossing or <br />use permits required by any other public agencies, railroads, or <br />private companies. <br />6. That the City agrees to accept all responsibility for the main- <br />tenance of the trail, including the collection of litter and repair <br />or replacement of the trail due to construction activities by the <br />by the Water Utility. <br />7. That the City agrees to reimburse the Board for any repair costs <br />incurred as a result of damage to existing sod, trees, fencing or <br />water conduit facilities due to the operation of the trail. <br />8. That the City agrees to defend and save and hold the Board and <br />City of Saint Paul harmless from any civil actions or liability <br />arising out of the uses authorized by the City. <br />9. That the Board shall retain sold discretion and rights to cancel <br />the "limited use permit" hereit..Lfore granted and to resume full <br />and sole use and proprietorship of said property upon 60 days <br />notice in writing directed to the City as its principal office <br />address where listed. <br />10. That the Board and the City agree to revoke the Tenth Rider to <br />Agreement permitting public use of said Board right -of -way as <br />a corridor for snowmobile recreational purposes. <br />Page 5 <br />- 2 - <br />
