SEP -09 -1992 10 :51 FROM SWEENEY' BORER & OSTROW TO LITTLE CANADA P.08/21 <br />area. In constructing this project, Developer will be <br />responsible for providing drainage on both sides of the proposed <br />berm, as approved by the City Engineer. <br />12. Additional Requirements. Developer shall pay part <br />dedication fees pursuant to City ordinances, which will be <br />payable at the time of building permit application. The <br />Developer shall comply with the Little Canada landscaping <br />ordinance. This Development Contract shall be subject to the <br />Agreement Between Owner /Applicant and City of Little Canada as <br />to Costs, dated June 9, 1992, between Heritage Development of <br />Minnesota, Inc, and the City of Little Canada, attached and <br />incorporated herein as Exhibit C. All monies deposited pursuant <br />to Exhibit C shall be applied to the deposit requirement under <br />Paragraph No. 9 above. <br />13. Letter of Credit. Developer shall furnish to the City <br />with an Irrevocable Letter of Credit in the amount <br />of Dollars <br />prior to the commencement of construction to guarantee the <br />completion of the public improvements. Said Letter of Credit <br />shall be immediately available for the City's use to complete <br />part or all of the construction project in the event that the <br />improvements are not completed in a timely and satisfactory <br />manner, as determined by the City. The Letter of Credit can be <br />reduced to <br />Dollars, after the first lift of bituminous is completed. <br />Page 9 <br />
