The basis of this conveyance and dedication is <br />that this property was to have been conveyed as part of a <br />previous development in this area, which appears to be in common <br />ownership. <br />18. construction Traffic. Developer agrees to have all <br />traffic associated with the construction of the public <br />improvements access the development area from Yorkton <br />Boulevard. No construction traffic is to access from Jackson <br />Street, accept that which is absolutely necessary to properly <br />install the public improvements. Failure to comply with the <br />conditions of this Paragraph and the conditions of Paragraph 19 <br />will result in suspension of the construction of the public <br />improvements. <br />19. Access. Developer agrees to maintain access to <br />properties abutting Jackson Street during the construction of <br />the public improvements. The City reserves the right to direct <br />the Developer's contractor as to the adequateness of access and <br />to make the necessary arrangements to provide access.
