SEP -09 -1992 10:49 FROM SLJEENEY BORER 8, OSTROW TO LITTLE CANADA P.05/ 21 <br />improvements shall be prepared by the Developer's engineer, and <br />approved by the City Engineer in accordance with City <br />specifications. It is further understood that the City must <br />approve the contractor who will undertake the installation of <br />the public improvements. The City Engineer shall inspect the <br />construction of the improvements, and upon satisfactory <br />completion of the construction, he shall certify the same and <br />recommend the acceptance of the improvements by the City. <br />Nothing in this provision shall prevent the Developer from <br />undertaking its own inspections as deemed necessary to ensure <br />satisfactory completion of the project. Developer shall also <br />complete construction staking for the project at Developer's <br />expense. <br />6. $ asements. The Developer shall acquire easements as <br />necessary for the construction and maintenance of the public <br />improvements pursuant to City requirements. The Developer shall <br />pay all costs relating to the acquisition of the necessary <br />easements, including attorneys' fees, costs, appraisals, the <br />cost of the necessary property, and any other special conditions <br />which the Developer shall negotiate with the affected property <br />owner. Developer also agrees to reimburse the City for any <br />costs associated with the acquisition of the easements including <br />drafting, review and recording. <br />7. Consents to Easements. The Developer shall obtain <br />consents to any required easements as necessary. <br />Page 6 <br />
