Setbacks. The reconfigured lot line establishes a side yard
setback of 11.2 feet from the property's existing house. The
Zoning Ordinance allows a minimum side yard setback of five feet if
the house existed prior to 25 June 1980, or a 10 foot setback if
the house was established after that date. Regardless of the time
at which the home was constructed, R -1 setback requirements have
been satisfied.
Easements. The submitted certificate of survey has appropriately
illustrated six foot wide drainage and utility easements along all
property lines.
Park Dedication. As a condition of subdivision approval, the
applicant should make the appropriate cash contribution to the
City's park fund for the newly created lot.
RECOMMENDATION
The proposed lot split confo is to all minimum lot size and setback
standards imposed in the R -1 Zoning District. As such, our office
recommends approval of the requested lot split subject to the
following conditions:
1. The applicant satisfy necessary park dedication /cash
contribution requirements for the newly created lot.
2.
