A building permit was denied on the basis that <br />construction of his house encroached on the setback requirements of <br />the south side of the property. Mr. Grabick has also requested a <br />variance to exempt him from this requirement so the addition can be <br />built. <br />Attached for reference: <br />Exhibit A - Site Plan Showing Proposed Addition <br />ANALYSIS <br />According to Section K in the General Provisions of the Zoning <br />Ordinance (903.010), the proposed addition qualifies as a <br />conditional use provided there has been no increase in the existing <br />non - conformity. Due to the fact that the setback encroachment has <br />remained unchanged, the proposed addition qualifies for a <br />conditional use permit. <br />In regard to Mr. Grabick's request to "erase" the non - conformity of <br />the setback, it was recommended after his first variance request <br />that the property in dispute be purchased from the adjacent <br />property owner.
