five of his neighbors, the owner of the property affected by the <br />setback encroachment was not one of them. <br />The water problems caused by his neighbor's fill, claimed by Mr. <br />Grabick, do not meet the conditions for a variance. Because <br />construction of his addition can proceed with a CUP, the refusal of <br />a variance would not cause a hardship on Mr. Grabick. <br />According to Section C.2.d of the General Provisions of the City <br />Ordinance (922.010), granting a variance without meeting all <br />conditions would confer special privileges on Mr. Grabick that are <br />denied the rest of the district. <br />RECOMMENDATION <br />Based on review of the information given, our office recommends <br />approval of a conditional use permit to allow Mr. Grabick to <br />construct his, addition but not a variance from setback <br />requirements.
