five of his neighbors, the owner of the property affected by the
setback encroachment was not one of them.
The water problems caused by his neighbor's fill, claimed by Mr.
Grabick, do not meet the conditions for a variance. Because
construction of his addition can proceed with a CUP, the refusal of
a variance would not cause a hardship on Mr. Grabick.
According to Section C.2.d of the General Provisions of the City
Ordinance (922.010), granting a variance without meeting all
conditions would confer special privileges on Mr. Grabick that are
denied the rest of the district.
RECOMMENDATION
Based on review of the information given, our office recommends
approval of a conditional use permit to allow Mr. Grabick to
construct his, addition but not a variance from setback
requirements. The property would be reclassified as a non-
conforming use.
pc: Kathy Glanzer
John Palacio
Tom Sweeney
John Grabick
2
Page 13
