MINUTES <br />PLANNING COMMISSION <br />DECEMBER 10, 1992 <br />CUP & <br />FILL PERMIT <br />MOGREN <br />PROPERTY <br />FENCE <br />ORDINANCE <br />The Commission reviewed the application for Conditional <br />Use Permit to allow the accessory use of industrial <br />property without a principle structure on the site. <br />The use proposed is the stockpiling of humus and peat <br />materials at the northwest corner of Spruce Street and <br />South Owasso Blvd. The property is owned by Robert <br />Mogren, Mogren Bros. Application has also been <br />submitted for a fill permit. <br />DeLonais reported that the Community Pride Committee <br />has been working on the clean -up of Ryan Industrial <br />Park, and the business owners in the Park have been <br />complaining about the Mogren stockpile. DeLonais <br />stated that he would like to see the property cleaned <br />up and the property owner given until July 1st to do <br />so. DeLonais felt that the CUP and fill permit <br />applications should be denied. <br />Tom Nielson, adjacent property owner, opposed the CUP <br />and fill permit, and reported that the stockpile is <br />higher than his building. Nielson reported that the <br />materials have been stockpiled since a year ago last <br />winter. Nielson wished to see the property cleaned up. <br />The City Planner reported that the City notified Mogren <br />Bros. of the violations, which included lack of a fill <br />permit and CUP since there is no principle building on <br />the site. Enforcement action has been frozen, however, <br />until action is taken on the applications before the <br />Commission. <br />The Commission discussed the situation and felt that <br />June 1st would be a more acceptable time frame for <br />cleaning up the property. <br />Garske recommended denial of the Conditional Use Permit <br />for accessory use of industrial property without a <br />principle structure on the site as well as fill permit <br />requested by Mogren Bros., and recommended that the <br />stockpile be removed from the site and property cleaned <br />up and regraded by June 1, 1993. <br />Motion seconded by Carson. <br />Motion carried 7 - 0. <br />Carson reported that the Community Pride Committee <br />has been working with Ryan Industrial Park property <br />owners. One of the issues discussed is the requirement <br />of screening of outdoor storage. The Code requires a <br />solid fence for screening purposes, however, the <br />property owners do not feel a solid fence would be <br />Page 5 <br />
