The applicant has also included a letter from one of the building tenants who has been <br />identified as one who has raised some of the previous issues with capacity and <br />organization of the site — namely, too many cars cluttering the property in an <br />unorganized fashion. That tenant indicates that they will take steps to manage their use <br />of the property to avoid the previous concerns and comply with the terms of the City's <br />regulations. <br />While this does not specifically address the number of vehicles, the site appears to have <br />reasonable capacity if property maintained and the regulations are observed. If this is <br />done, there should be room to provide the off -site storage for the neighboring business <br />as proposed. <br />Since the off-site storage is an Interim Use Permit, it will run for a period of years and <br />expire, after which the applicant and operator will need to apply for a new IUP. In <br />addition, each party will need to apply for and demonstrate compliance to qualify for the <br />annual licenses required for this use <br />Summary and Recommendation <br />With the site plan and representations provided by the applicant, the CUP and IUP may <br />be approved, subject to ongoing compliance with the terms of the code, and continued <br />qualification for the annual licensing. If those terms are not met, and the license falters, <br />the applicant would be in violation of both licensing and zoning regulations affecting the <br />use. As such, staff would recommend approval, consistent with the Planning <br />Commission recommendation, subject to ongoing demonstration that the site is not <br />over - capacity, that the parking on the site is done in an orderly and proper manner <br />according to the zoning ordinance, and that the storage areas are utilized in a way that <br />meets both the zoning regulations and the requirements of the Fire Code for access. <br />pc: Kathy Glanzer <br />Steve Westerhaus <br />Lee Elfering <br />3 <br />
