Hanson <br />MEMORANDUM <br />TO: Mayor Blesener and Members of the City Council <br />FROM: Joel Hanson, City Administrator <br />DATE: August 9, 2013 <br />RE: Right -of -Entry Agreement — St. John's Church <br />To keep the Little Canada Road project moving forward, we need to approve a right -of- <br />entry agreement with St. John's Church of Little Canada. This agreement will provide <br />indemnification to the Church for any problems arising from our activities. As you <br />know, we will be finalizing easement documents once appraisal information is received. <br />This agreement lets us work in the meantime. <br />A copy of the draft agreement is attached to this memo. Staff has been working with <br />legal counsel from the St. Paul Diocese in drafting this document. The Diocese must <br />approve this type of transaction before it can be executed by the local parish. <br />We are in the process of finalizing this agreement including the addition of descriptions <br />for the areas we need to enter upon. Some of the work will be done for St. John's that <br />they will pay for above the assessed amount. <br />Staff anticipates having the final document ready for Wednesday's meeting. <br />1 <br />
