MINUTES <br />CITY COUNCIL <br />AUGUST 14, 2013 <br />RESOLUTION NO. 2013 -8 -143 — APPROVING THE RIGHT -OF- <br />ENTRYAGREEMENT WITH ST. JOHN'S CHURCH RELATIVE TO <br />THE LITTLE CANADA ROAD PROJECT AND AUTHORIZING THE <br />MAYOR AND CITY ADMINISTRATOR TO EXECUTE ON BEHALF <br />OF THE CITY <br />The foregoing resolution was duly seconded by McGraw. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />PINETREE The City Administrator reported that the City provided a mortgage for <br />POND — 50% of the cost of acquiring 2966 Arcade Street for Masterpiece Homes. <br />PARTIAL That property is now being developed as the Pinetree Pond development. <br />RELEASE Masterpiece Homes is obtaining construction loans for two lots within this <br />OF development and needs the City's mortgage released from these two lots. <br />MORTGAGE The Administrator reported that staff is recommending approval of the <br />Partial Release of Mortgage subject to the Pinetree Pond Development <br />Agreement being recorded prior to the recording of the Partial Release of <br />Mortgage. The Partial Release of Mortgage should take a subordinate <br />position to the Development Agreement. <br />Keis introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2013 -8 -144 — APPROVING THE PARTIAL <br />RELEASE OF MORTGAGE FOR 2966 ARCADE STREET AS <br />REQUESTED BY MASTERPIECE HOMES SUBJECT TO THE <br />RECORDING OF THE PINETREE PONDS DEVELOPMENT <br />AGREEMENT PRIOR TO THE PARTIAL RELEASE OF <br />MORTGAGE SO THAT THE NEW MORTGAGE IS SUBORDINANT <br />TO THE DEVELOPMENT AGREEMENT, AND AUTHORIZING <br />THE MAYOR AND CITY ADMINISTRATOR TO EXECUTE THE <br />RELATED DOCUMENTS ON BEHALF OF THE CITY <br />The foregoing resolution was duly seconded by Montour. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />DON Don Gagne appeared before the Council expressing concern with the <br />GAGNE- City's intent to locate a new Public Works garage on the former Brings <br />PUBLIC property on Centerville Road Gagne presented pictures of both the <br />WORKS current Public Works garage on Country Drive as well as the former <br />GARAGE Roseville Plumbing property that the City purchased and is using for <br />LOCATION Public Works storage. Gagne noted the use of these two properties and <br />the types of storage that is being done at each location. Gagne felt that <br />7 <br />
