MINUTES <br />PLANNING COMMISSION <br />MAY 13, 1993 <br />CUP FOR <br />OFFICE USE <br />303 EAST <br />LITTLE CANADA <br />ROAD <br />Mr. John Gerten appeared before the Commission <br />requesting approval of a Conditional Use Permit to <br />allow an office use in an RB Zoning. Mr. Gerten <br />reported that the City Council has rezoned the property <br />at 303 East Little Canada Road to Residential Business, <br />and in order for him to locate his law office at that <br />site a Conditional Use Permit is required. <br />Gerten referred to the Public Works Superintendent's <br />letter dated May 7th regarding the County's position on <br />the Little Canada Road access for the site. Gerten <br />reported that he talked to Mr. Solar of the County, <br />after he had his conversation with Mr. Harris, and <br />Gerten reported a different interpretation of Mr. <br />Solar's comments. Gerten reported that Mr. Solar <br />indicated that it was better not to have a driveway <br />access onto Little Canada Road, however, it was a <br />matter of degree. Solar indicated that the County has <br />no jurisdiction in this matter, and should the City <br />choose not to have this access, it should be addressed <br />in the Conditional Use Permit. Solar indicated that if <br />the City wants to raise the issue, it should do so <br />because the County has no jurisdiction. <br />Gerten compared the activity at the 303 East Little <br />Canada Road site with that of the office buildings on <br />the west side of the freeway. Those office buildings <br />have 201 parking spaces with one access point, while <br />303 Little Canada road has 1 /20th the parking spaces <br />with two access points. <br />Gerten reported that he would be willing to go along <br />with a right -turn in and right -turn out situation on <br />Little Canada Road. Gerten felt the Little Canada Road <br />access point was important for someone looking for the <br />office heading west on Little Canada Road. Otherwise, <br />that customer will be by the office before realizing it <br />and will have to cross the freeway and turn around. <br />Gerten did not believe a right -turn in and out would be <br />a problem. <br />DeLonais reported that he had a 45 minute conversation <br />with Mr. Solar of the County. DeLonais referred to the <br />second paragraph of Dave Harris's letter, and reported <br />that Mr. Solar indicated that it was not the intention <br />of the County to tell the City what to do.
