Hanson <br />Mr. Osland contacted me on July 16, 1993 and asked me to present a <br />proposal to the City Council. His proposal relates to the inconvenience <br />he has endured associated with the completion of the Centre Place <br />development on Rosewood Drive. As you may know, Mr. Osland was concerned <br />with this development back in 1990 when the grading for the residential <br />area was commenced. He was very upset with the fact that the trees that <br />had existed on the site were removed. He was also inundated with water <br />because temporary grading was not established to properly control <br />run -off. Lastly, the drainage swale in the rear yard areas adjacent to <br />his property has not been satisfactorily completed. (This problem will be <br />rectified very soon.) <br />Mr. Osland feels he has a cause of action against the City regarding this <br />matter. Rather than pursue that, he is asking for reimbursement of his <br />expenses to -date amounting to $365 (for attorney's fees, photos, etc.). <br />If he is paid this amount, he would sign a release that no further action <br />would result on his part. <br />In considering this matter, I would caution the Council to consider any <br />precedent that could be set by making such a payment. I would also <br />question our legal liability to Mr. Osland for the situation which <br />transpired. Furthermore, I would recommend that the City Attorney advise <br />you on this issue. Please keep in mind that I am not recommending a <br />course of action at this point in time, but only forwarding a citizen's <br />request. <br />Should you have any comments on this matter in the meantime, please let me <br />know. <br />JRH:kpv <br />cc: Tom Sweeney, City Attorney <br />Norm Osland <br />Page 114 <br />
