Pratt <br />May 26, 1993 <br />Page 3 <br />restrictions of that sort are not considered unusual in townhouse <br />documents and because you will have in place a board of homeowners <br />which can monitor and react to particular circumstances. <br />City Involvement. <br />Remember also that the City will make review of the covenants <br />a condition of its approval of the plat. If the City wishes, we <br />could make City approval an additional requirement for any <br />amendment which would increase the number of slips and so forth. <br />Effective Enforcement. <br />I believe another concern was raised by one of the neighbors <br />to the effect that townhouse associations don't always do their <br />job. It's true. There are homeowner association boards that are <br />so passive or fearful that they are not consistent in enforcing <br />their own documents. In my experience, however, ineffective, <br />passive boards of directors are found only in lower priced <br />projects, and typically those that have a high proportion of <br />renters. There is no better predictor of whether a board will be <br />active and engaged than the average value of the homes. I can <br />virtually guarantee that in a townhome development such as you <br />propose for this site, you will have very active members and <br />directors. Each of the homeowners will have a substantially <br />above - average investment in their home, they will have chosen to <br />live here because they appreciate the quiet beauty of this small <br />lake and they will not need to be told that their own tranquility <br />as well as the value of their investment will depend upon vigilant <br />management of the property. <br />In short, I think you can offer the neighbors on the lake the <br />comfort that a well -drawn set of townhouse restrictions, which <br />recognizes the concerns of all of the residents on the lake, will <br />protect the character of Twin Lake better than a new single family <br />development. <br />NWG /jah /3046p <br />Yours truly,_` <br />C 4---) <br />N.
