MINUTES <br />CITY COUNCIL <br />AUGUST 28, 2013 <br />The City Administrator reported that the City Attorney and City staff will <br />go through the entire Municipal Code, and this will be a lengthy process. <br />He indicated that the process will likely involve the need for some Council <br />workshops. It was also noted that the need to proceed with a <br />recodification of the Municipal Code became apparently recently due to a <br />request the City received to repeal its indecent exposure regulations. <br />Based on that request, the City Attorney recommended the recodification. <br />The Council agreed that the recodification was needed. <br />CALL PUBLIC <br />HEARING TO <br />EXTEND <br />AUTO - RELATED <br />USE <br />MORATORIUM <br />CLARIFY CUP - <br />3176 RYAN LANE - <br />RUSS FISCHER <br />The City Planner reviewed his August 22, 2013 report noting that the <br />in September of 2012 the City enacted a moratorium to undertake a study <br />of auto - related uses, following discussions on amendments to various parts <br />of the Zoning Ordinance and City Code that regulate these uses. The <br />Planner indicated that the moratorium is set to expire on September 26, <br />2013. Given the issues relative to auto - related uses are still under study, <br />the Planner recommended that the Council extend the moratorium for an <br />additional 18 months (the maximum statutory period). The Planner <br />reported that the study and recommended amendments will be submitted <br />to the Council this fall, but the State Statutes only allow for one extension <br />of a moratorium. The Council has the ability to cancel the moratorium at <br />any time prior to the full 18 months. <br />The Planner reported that the Council must hold a public hearing to <br />consider the extension. Given statutory requirements, he recommended <br />that the hearing be held on September 11, 2013 and that action could take <br />place on either September 111 or on September 25"'. <br />McGraw introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2013 -8 -148 — CALLING A PUBLIC HEARING TO <br />CONSIDER EXTENSION OF AUTO-RELATED USE <br />MORATORIUM ON SEPTEMBER 11, 2013 AT 7:30 P.M. <br />The foregoing resolution was duly seconded by Boss. <br />Ayes (4). <br />Nays (0). Resolution declared adopted. <br />The City Planner reviewed his report dated August 22, 2013 relative <br />to the Conditional Use Permit recently approved for 3176 Ryan Lane <br />owned by Russ Fischer. The Conditional Use Permit was for automotive <br />repair with conditions related to parking. While the Code requirement for <br />parking on this site is 17 spaces, the applicant's site plan showed a total of <br />8 improved parking spaces.
