AGREEMENT, dated <br />DEVELOPMENT CONTRACT <br />, 19, by and between the <br />CITY OF LITTLE CANADA, a Minnesota municipal corporation, ( "City ") <br />and the Schletty Family Partnership, a Minnesota partnership, <br />( "Developer "). <br />1. Request for Improvement. The Developer has requested the <br />City to allow the construction of extensions of sanitary sewer, storm <br />sewer, water main, curb and gutter, and bituminous roadways to serve <br />and provide access to the proposed plat of Fredrickshaven Second <br />Addition, within the City of Little Canada to serve the following <br />described property: <br />Lots 1 through 12, Block 1, Fredrickshaven Second Addition, <br />County of Ramsey, State of Minnesota. <br />The improvement is necessary to provide access and utilities <br />for the residential subdivision located in the above - described plat <br />as shown on Exhibit A. <br />2. Conditions of Approval. The City hereby approves <br />construction of extensions of sanitary sewer, storm sewer, water <br />main, curb and gutter, and bituminous roadways to serve the <br />Fredrickshaven Second Addition Plat, conditioned upon the Developer <br />entering into this Agreement and guaranteeing compliance with the <br />terms of this Agreement. <br />3. Compliance with Laws and Regulations. The Developer <br />represents to the City that to the best of its knowledge the <br />extension of the public improvement to the Fredrickshaven <br />-1- <br />Page 16 <br />
