later than November 30, 1993. The second lift of asphalt for the <br />bituminous roadway is to be completed no later than August 1, 1994. <br />Plans for said improvement shall be prepared by Dennis Brown, <br />Registered Engineer, and approved by the City Engineer in accordance <br />with City specifications. It is further understood that the City <br />must approve the contractor who will undertake the installation of <br />the improvements. A copy of Developer's contract with the approved <br />contractor shall be provided to the City. The City Engineer shall <br />inspect the construction of the improvement, and upon satisfactory <br />completion of the construction, he shall certify the same and <br />recommend the acceptance of the improvement by the City. Nothing in <br />this provision shall prevent the Developer from undertaking its own <br />inspections as deemed necessary to ensure satisfactory completion of <br />the project. Developer shall also complete construction staking for <br />the project at Developer's expense. <br />6. Easements. The Developer shall acquire easements as <br />necessary for the construction and maintenance of the public <br />improvement pursuant to City requirements. The Developer shall pay <br />all costs relating to the acquisition of the necessary easements, <br />including attorneys' fees, costs, appraisals, the cost of the <br />necessary property, and any other special conditions which the <br />Developer shall negotiate with the affected property owner. <br />Developer also agrees to reimburse the City for any costs associated <br />with the acquisition of the easements including drafting, review and <br />recording. <br />7. Consents to Easements. The Developer shall obtain consents <br />to any required easements as necessary. <br />-3- <br />Page 18 <br />
