satisfaction of the City Engineer, the funds deposited pursuant to <br />this paragraph may be used by the City to satisfy costs of <br />restoration or repair, or to satisfy any other costs incurred by the <br />City due to Developer's failure to complete the project. <br />10. Completion and Acceptance of the Project by the City. No <br />building permits shall be issued by the City until the installation <br />of sanitary sewer, storm sewer, water main, curb and gutter, and the <br />first lift of bituminous. <br />11. Grading and Drainage Plans. The Developer shall complete a <br />drainage and grading study as required for subdivision approval and <br />furnish said study to the City Engineer. Said study must be approved <br />by the Ramsey - Washington Watershed District including the completion <br />of the Municipal Coordination Checklist. It is also understood that <br />grading and drainage are to be accommodated so as not to create any <br />negative impact from other residential properties in the area. <br />12. Restoration of Neighboring Properties. Restoration of <br />driveways and yard areas of neighboring properties affected by the <br />construction of these improvements shall be completed no later than <br />November 30, 1993. The properties shall be returned to a condition <br />reasonably similar to their condition prior to the construction of <br />the improvement. To define restoration activities, the Developer <br />shall negotiate specific conditions with affected neighboring <br />property owner(s). Said conditions shall be in writing and made a <br />part of this document in part of the easement documents, as set forth <br />in Exhibit B. <br />-5- <br />Page 20 <br />
