completed no later than June 30, 1994. The second lift of asphalt <br />for the bituminous roadway is to be completed no later than August 1, <br />1995. Plans for said improvement shall be prepared by Jonathan L. <br />Faraci, Registered Professional Engineer, and approved by the City <br />Engineer in accordance with City specifications. It is further <br />understood that the City must approve the contractor who will <br />undertake the installation of the improvements. A copy of <br />Developers' contract with the approved contractor shall be provided <br />to the City. The City Engineer shall inspect the construction of the <br />improvement, and, upon satisfactory completion of the construction, <br />he shall certify the same and recommend the acceptance of the <br />improvement by the City. Nothing in this provision shall prevent the <br />Developers from undertaking their own inspections as deemed necessary <br />to ensure satisfactory completion of the project. Developers shall <br />also complete construction staking for the project at their expense. <br />6. Easements. The Developers shall acquire easements as <br />necessary for the construction and maintenance of the public <br />improvements pursuant to City requirements. The Developers shall pay <br />all costs relating to the acquisition of the necessary easements, <br />including attorneys' fees, costs, appraisals, the cost of the <br />necessary property, and shall comply with any other special <br />conditions which the Developers shall negotiate with the affected <br />property owner(s). Developers also agree to reimburse the City for <br />any costs associated with the acquisition of the easements including <br />drafting, review and recording. <br />7. Consents to Easements. The Developers shall obtain consents <br />to any required easements as necessary. <br />-3- <br />Page 62 <br />
