MINUTES <br />PLANNING COMMISSION <br />SEPTEMBER 12, 2013 <br />The Planner then reviewed the section of his report related to "Motor <br />Vehicle Sales Lot, Outdoors ". The Planner stated that in reviewing the <br />current Code requirements, it was his feeling that there were no changes <br />needed in this section. The biggest issues for outdoor sales relate to <br />compliance with the current standards, not the standards themselves. The <br />Planner noted that auto repair businesses came to the City indicating that <br />they occasionally acquire vehicles as part of their repair business and need <br />to have a State sales license in order to transfer titles. Given the limitation <br />on outdoor sales licenses, the City put in place the indoor sales license. <br />Again, the State requires that indoor sales license have space for indoor <br />sales /display of five vehicles. The Planner noted that it has been the <br />combination of the auto repair license and the indoor sales license that has <br />caused enforcement problems. The Planner further noted that most of the <br />business with auto repair licenses and sales licenses (either indoor or <br />outdoor) also want outdoor storage licenses. He pointed out that the City <br />requires outdoor sales lots to have paved areas for the vehicles for sale. <br />Outdoor storage areas do not need to be paved. Sales lots have bled into <br />storage areas, and again this is making it difficult for code enforcement to <br />determine whether or not there is compliance with the conditions of CUPs. <br />The Planner then reviewed the report section on "Salvage Vehicles Sales <br />& Repairs ". The Planner noted that the salvage vehicle repair license <br />provides an allowance for outdoor storage of parts. With regard to the <br />current Code regulations, the Planner recommended expansion of #5 <br />which clarifies how parts storage can occur; smaller parts cannot be stored <br />on the ground, while larger parts could be. The Planner indicated that <br />businesses with salvage repair licenses claim that it is a necessary part of <br />their business that they be allowed parts storage for use in assembling <br />parts into a working vehicle. The issue is how much storage to allow <br />without creating a junk yard. <br />The Planner reviewed the final portion of his report which suggests the <br />option of limiting the combination of the licenses discussed. These <br />options are: <br />a. Auto Repair License, with one or either Outdoor Storage or <br />Vehicle Sales Lot; <br />b. Salvage Repair License, with one or either Outdoor Storage or <br />Vehicles Sales Lot; <br />c. Adoption of changes to Indoor Sales as outlined in the Planner's <br />report; <br />d. Consideration of additional limitations on Outdoor Storage for <br />Salvage Repair. <br />The Planner stated that it was his recommendation that the revised <br />language be adopted for "Motor Vehicle Sales, Indoor" and for "Salvage <br />- 3 - <br />
