MINUTES <br />CITY COUNCIL <br />SEPTEMBER 11, 2013 <br />EXTENSION OF The Mayor opened the public hearing to consider the extension of <br />AUTO - RELATED the auto - related use moratorium which expires on September 26, <br />USE 2013. <br />MORATORIUM <br />The City Administrator reported that the City adopted a one -year <br />moratorium in September of 2012 in order to provide time to study auto <br />sales lots and related uses in the City. The study is not yet complete, and <br />staff is recommending that the moratorium be extended. State Law allows <br />for one extension of a moratorium for up to an 18 month period. Staff is <br />recommending the 18 -month extension and the Administrator noted that if <br />the study is completed earlier, the moratorium can be lifted at any time <br />during the 18 -month period. <br />The Administrator reviewed the City Planner's September 6, 2013 report <br />which recommends the extension based on the following findings: <br />1. The moratorium is necessary to protect the City's planning process <br />for auto -sales and related uses. <br />2. Automotive uses have raised concerns related to land use <br />management and enforcement in the past. <br />3. Further study is required under an extension of the existing interim <br />ordinance to provide adequate time for consideration of potential <br />changes in regulations. <br />There was no one from the general public present wishing to comment on <br />this matter. <br />Upon motion by Keis, seconded by Boss, the public hearing was closed. <br />Keis introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2013 -9 -153 — AMENDING ORDINANCE NO. <br />2012 -9 -733 OF THE LITTLE CANADA CITY CODE, BY PROVIDING <br />FOR AN EXTENSION OF THE INTERIM ORDINANCE <br />ESTABLISHING A MORATORIUM ON THE CONSIDERATION OF <br />AUTO SALES LOTS AND RELATED USED IN THE CITY OF <br />LITTLE CANADA <br />The foregoing resolution was duly seconded by Boss. <br />Ayes (4). <br />Nays (0).
