MINUTES <br />PLANNING COMMISSION <br />MAY 12, 1994 <br />CUP FOR Mr. Gary Quam, 2934 LaBore Road, appeared before the <br />SECOND Commission requesting approval of a Conditional Use <br />ACCESSORY Permit in order to construct a second accessory <br />BUILDING - building on his property bringing total accessory <br />QUAM building area to over 1,000 square feet. <br />Mr. Quam submitted a written response to the comments <br />contained in the City Planner's report regarding the <br />necessity for a front yard setback variance. Mr. Quam <br />agreed that a variance would be needed, but noted that <br />he is proposing to place his accessory building in line <br />with the new house recently built on the adjacent <br />property. Mr. Quam, therefore, felt that his proposal <br />would not be setting a precedent since that precedent <br />had already been set by the house next door. Quam <br />reported that he is proposing to place the accessory <br />building in this location since he would like to avoid <br />cutting down some oak trees on his property. Quam <br />reported that he is proposing the setback at 24 feet <br />from the front property line. Code requires a 30 foot <br />setback. <br />The Administrative Assistant pointed out that the <br />application before the Commission is for a Conditional <br />Use Permit. No variance application has been made, <br />therefore, a public hearing to consider a variance has <br />not been published, nor have property owners been <br />informed. <br />Quam reported that he is proposing to line up his <br />accessory building with the structure next door, and <br />did not realize that a variance would be required. <br />Quam indicated that he could comply with the 30 foot <br />setback, however, would lose some oak trees. Quam <br />expressed concern that the new home adjacent to his <br />property was allowed to construct within the required <br />setback area, and he would not be allowed this same <br />privilege. <br />Garske felt that the setback of the house next door was <br />an enforcement problem. Garske pointed out that a <br />variance request for this house did not come before the <br />Planning Commission. Garske indicated that he had a <br />problem with allowing two accessory buildings on the <br />property, and asked why Mr. Quam did not just add on to <br />his existing accessory building. <br />5 <br />Page 7 <br />
