MINUTES <br />PLANNING COMMISSION <br />MAY 12, 1994 <br />with the Variance request. Schletty indicated that he <br />has reviewed the minutes of a previous Council action <br />in 1990 for a similar request on Rose Lane. <br />DeLonais pointed out that just down the street on <br />LaBore Road there is a similar situation where a <br />property is accessed by a long driveway from LaBore. <br />DeLonais acknowledged, however, that this situation is <br />probably grandfathered in from several years ago. <br />Schletty again stated that he had no problem with the <br />variance request, but wondered if requiring that the <br />Mason property be replatted would solve some concerns. <br />Mr. Mason suggested that the Keenan Variance request be <br />approved, and at such time as the road is improved in <br />the future, Keenan would be required to share in the <br />cost of the improvement. <br />DeLonais pointed out that Keenan could be required to <br />sign a Waiver of Right to Appeal Special Assessments <br />for the improvement of Lake Street. DeLonais also <br />suggested that the City can take the position that <br />should any further development be requested along Lake <br />Street, the road would have to be improved. <br />Mr. Schletty recommended approval of the Variance to <br />construct a home on property without frontage on an <br />improved street as requested by Kevin Keenan for Lots <br />10 and 11, Mason Manor, subject to Mr. Keenan's signing <br />a Waiver of Right to Appeal Special Assessments for <br />future improvement of Lake Street, and with the <br />position that Lake Street would be required to be <br />improved if additional development is requested along <br />that street. <br />Motion seconded by Knudsen. <br />Motion carried 4 - 1. Davison voting against. <br />Davison felt that Lake Street should be improved now, <br />believing that the City will receive similar variance <br />requests in the future. <br />4 <br />Page 6 <br />
