I rAC <br />Northwest Associated Consultants, Inc. <br />U R B A N P L A N N 1 N G • D E S I G N • M A R K E T R E S E A R C H <br />PLANNING REPORT <br />TO: Little Canada Planning Commission <br />FROM: Cary Teague /Stephen Grittman <br />DATE: 12 April 1994 <br />RE: Little Canada - A & W - Conditional Use Permit <br />FILE NO: 758.09 - 94.04 <br />BACKGROUND <br />Charles and Marie Haglund, are requesting a conditional use permit <br />to sell vegetables, flowers, pumpkins, Christmas trees, fruit and <br />plats as an outdoor service in the parking lot of their A & W <br />Drive -In Restaurant. The subject property is located at the <br />Northeast corner of Rice Street and Owasso Boulevard, within the B- <br />3 Zoning District which conditionally permits open or outdoor <br />service, sale and rental as principal or accessory use. <br />Attached for reference: <br />Exhibit A - Site Location <br />Exhibit B - Site Plan <br />ISSUES & ANALYSIS <br />As mentioned above, Section 911.040 E. of the Little Canada City <br />Code, conditionally permits "Open or outdoor service, sale and <br />rental as a principal or accessory use... ". Because the subject <br />property contains an A &W Restaurant the proposed use must be <br />considered accessory to the principal use (the A &W). <br />Section 902.010 of the City Code defines Accessory Use as "a <br />subordinate building or use that is located upon the same lot on <br />which the main building or use is situated and which is reasonably <br />necessary and incidental to the conduct of the primary use of such <br />building or main use ". As the City reviews this application, it <br />should consider if the proposed uses are truly accessory to the <br />principal use on the property.
